理论与历史的背反--对"人民内部矛盾"提法的反思

“人民内部矛盾”是在特殊的历史条件下提出的政治概念,随着社会的发展变化,这一概念已经失去继续存在的理由。因为：第一,该概念是法制不健全的年代的产物,其实质是等级制和“人治”模式的反映,它与“依法治国”的原则不相一致,不符合“法律面前人人平等”的现代宪法精神;第二,该概念存在理论缺陷,其模糊性、不确定性与自我矛盾性使这一概念缺乏自洽性与始终一贯性;第三,该概念在社会实践中已经失去其积极意义,从身份上界定人民与敌人的标准如家庭出身、思想意识、剥削与否已被证明是完全行不通的。任何人违法犯罪都应当受到法律的制裁。

The Theoretical and Historical Misunderstand--Reflect to the Wording of "Contradictions among the People"

"Contradictions among the people"is a political concept put forward under special historical condition. Along with the development of society, this concept has lost its existing reason. Because: first, this concept was raised at the age when the legal system was not perfect, is inconsistent with the principle of "administering a country by law"; second, there is a theoretical defect in the concept, and its vagueness uncevtainty and self-contradiction deprive this concept of self-harmony and unity; third, its positive significance has disappeared in social practice, to differ people from enemy by family origin, personal profession, thought and consciousness, exploiting or not has turned out to be a mistake. Everybody who breaks the law or commits a crime will be all punished according to law.
