PPP与政府采购:法律冲突与改革建议

我国PPP项目经历了4年爆发式增长,开始步入规范发展阶段。完善的PPP模式制度构建是PPP规范化发展的基础,而PPP模式的特性与现行法律制度冲突日渐凸显。本文将以PPP项目采购为视角切入,分析现行政府采购法律体系与PPP项目采购之间存在的冲突与矛盾,从法律适用、采购政策、采购程序等角度提出优化建议,力求打通PPP项目采购渠道。

PPP and Government Procurement: Legal Conflict and Reform Proposals

There has been an explosive growth in China''s PPP projects for four years; the normative development stage has come recently. A perfect system of PPP model is the basis for the development of PPP standardization, however, the conflict between the unique characteristics of PPP model and the current legal system has become increasingly prominent. This paper analyzes the conflicts and contradictions between current government procurement legislation and PPP project procurement from project procurement perspective; and puts forward suggestions in the sight of law application, procurement policy, procurement procedures and etc., to broaden PPP project procurement channels.
