| 摘 要： | 著作人身权是基于作品的创作而产生,并通过作品这一媒介来涉及作者人格利益的非财产权利,其并非严格意义上的人身权。不能简单地根据人身权与自然人的人身不可分离的民法原理得出著作人身权不可转让的结论。除署名权以外的其他著作人身权可随著作财产权一道转让。

| Abstract: | Personal rights in copyright,which are generated once upon creation of a work and involve interests of a author＆#39;s person-ality by medium of the work,are non-property rights but do not strictly follow the literal meaning of personal rights. Simply based on the principle of civil law that personal right and natural person are inseparable,it is inappropriate to get a conclusion that none of the per-sonal rights in copyright could be transferred. Except the right of signature,the other personal rights in copyright can also be transferred by accompanying the possession transfer of property rights in copyright. |
