中国法学教育与法律职业发展的困境与出路

中国高等院校法学教育的发展总体上促进了法律职业发展,但还存在着法学教育与法律职业脱节、国家司法考试与法学教育不协调等问题。应当进一步改革法学教育培养模式,使法学教育与国家司法考试形成良性互动,并逐步改革初任法官、初任检察官录用制度,促进法官、检察官录用制度与国家公务员录用制度分离,使中国法治建设人才素质不断提高。

Dilemma of Legal Education and Legal Professional Development in China and Countermeasures

By and large, the development of legal education in our colleges and universities has helped develop legal profession, but there exist problems such as legal education being out of line with legal profession, and national judicial examination being discordant with legal education, etc. It is suggested that our colleges and universities should further reform our training modes to make positive interactions between legal education and national judicial examination, gradually perfect the system for employing judges and prosecutors and separate the employment system of judges and prosecutors from that of national public servants to improve the quality of talent-oriented education during our legal construction.
