| 摘 要： | 我国将加入世界贸易组织，知识产权保护也将与国际接轨。世贸组织的TRIPS协议为知识产权的保护和执法设定了一些多边国际标准，我国应加以重视。就该协议与我国《商标法》关于商标的定义、商标权的取得、权力范围及限制等内容进行简要的比较研究。

| Abstract: | China will join the World Trade Organization and the protection of Intellectual Property Rights will be integrated with that of the world.The multiateral international standard set by WTO's TRIPS' agreement for the protection of law should be observed.This article focus briefly on the comparisons between TRIPS and China's Trade Mark Law in the aspects of the definition,the ways in obtaining trade marks,the rights and the limitation. |
