论宪法学的价值性与现实性——以宪法学方法论的类型化为中心

宪法学的根本问题是如何处理宪法的应然与实然即宪法的价值、规范与现实之间的关系。从应然与实然的层面上探讨并对由此而形成的具有典型性的宪法学方法论流派进行梳理，宪法学的方法论可以分为价值有涉的宪法学方法论、以规范宪法为中心的宪法学方法论、以现实宪法为中心的宪法学方法论和整合型的宪法学方法论。转型时期中国的宪法学方法论将向整体性、自治性和动态性的方向发展。

On the Value and Reality in Constitutional Jurisprudence --Taking the Classification of Methodology of Constitutional Jurisprudence as the Center

The fundamental issue of the study of the constitutional jurisprudence is how to deal with the relationship among the value, norms and reality of the Constitution. This article discusses four typical kinds of methodologies of constitutional jurisprudence from the perspective of ought and reality： methodology referring to value, methodology with normative Constitution as its center, methodology with real Constitution as its center and integrative methodology. A kind of overall, autonomous, dynamic methodology of constitutional jurisprudence should be established in transferring China.
