法治视野中的市民社会

市民社会是与政治国家相对应的社会生活领域。独立的市民社会是法治形成的必要社会条件。市场经济作为市民社会的经济形式促进法律的形式合理性发展，并孕育社会普遍的法治理念。市民社会权利以各种形式制约国家权力，是现代民主政治发展的基础和重要社会条件。中国在探求法治现代化的过程中，应充分重视市民社会的基础作用与决定作用，为当代中国法治建设提供富有价值的借鉴意义。同时，有必要对西方市民社会理论做出正确的鉴别、吸收。

Civil Society in the Legal System

Civil society is the field of societal life opposed to the political nation. An independent civil society is the indispensable condition for the formation of the rule of law. Market economy enhanced the reasonable development of the formality of legal system and generated the spirit of the rule of law. The rights of civil society restrict the power of the state in all kinds of forms. It is the foundation and important social conditions of modern democratic development. In the process of exploring the route of the modernization of legal system in China, the basic and decisive roles of civil society shall be attached full importance to provide reference for modern China＇s democracy construction. At the same time, the western civil society theories shall be appropriately differentiated and absorbed.
