| 摘 要： | 《刑事诉讼法》第8条规定，人民检察院依法对刑事诉讼实行法律监督。根据这一规定，人民检察院当然有权对死刑复核程序进行诉讼上的法律监督，以保障死刑的正确适用，达到逐步控制死刑适用规模的目的。但是，我国目前对死刑复核程序进行监督的途径和措施在立法上尚付阙如。因此，加强死刑复核程序检察监督的理论与实务研究显得非常必要，它已成为刑事诉讼法学界的一个重要课题。

| Abstract: | The eighth item of Criminal Law regulates that People's Procuratorate has right to supervise criminal lawsuit accordingly to law.On this basis,People's Procuratorate surely has right to supervise death sentence re-examination procedure in lawsuit aspect,so that to ensure proper application of death sentence and to realize reduction of death sentence's application scope gradually.But at present,we still lack approaches and measures in legislation about how to supervise death sentence re-examination procedure... |
