党政体制重构视阈下政法工作推进逻辑的再审视—基于《中国共产党政法工作条例》的解读

十八大以来，我国党政体制正进行着深刻且具中国特色的制度性重塑。作为建党以来政法战线首部党内法规，2019年初颁布的《中国共产党政法工作条例》明确了党管政法的“上下左右”关系，既是对政法工作经验的总结与再次确认，也是对政法委职责与运作的重新规范，为新时代政法工作的开展建章立制。政法系统的发展与我国党政体制的探索息息相关，党管政法的历史演变与政法系统内部的“小权分散”相互促进并深刻勾连。《中国共产党政法工作条例》的出台因应了党政体制重构和归口管理逻辑复兴的时代潮流，是党内法规体系化在政法工作中权力自我规训的表现。监察体制改革对政法工作构成了竞争性代理和小权分散加剧的双重挑战。相应的，归口管理逻辑的复兴也带来协调党内“系统”间关系的新问题，而小权分散态势的加剧意味着《中国共产党政法工作条例》对政法委运作的再规范尚有赖于“以审判为中心”改革的真正落地。

Promoting the Political-legal Work against the Backdrop of Political Reform

Since the 18th Party Congress, our political system has undergone profound restructuring with Chinese characteristics. The “Regulation on the Political-legal Work” released earlier 2019 is the first party regulation on relevant work. It asserts the party leadership in the political-legal work but also intuitively regulates the “up, down, left and right” relationship among different party organs. The paper sets out to examine the 2019 Regulation. Specifically, we explore how it factors in forty years’ experience and also reflects the new consensus in the center. What is the political logic behind the 2019 Regulation? What are the political implications? The paper examines the logic of political-legal work in the new era from multiple perspectives, such as the revival of the party’s system, the self-discipline of the party, and coordination both within and out of the political-legal system.
