| 摘 要： | 鉴于醉酒驾驶机动车和追逐竞驶现象日益严重并已成为危害公共交通安全的严重隐患，《中华人民共和国刑法修正案（八）》增设了危险驾驶罪，有效遏制了危险驾驶行为。但人们对危险驾驶罪构成要件的理解存在分歧，因而应当尽快出台立法解释或司法解释，细化其情节，规范执法，并拓宽危险驾驶罪的适用范围，规制毒驾、“三超”等危险驾驶行为，更好地维护公共交通安全。

| Abstract: | Because the increasing drink driving and drag driving became hidden danger of public transportation safety, ＂the A- mendment of the Criminal Law of the People＇ s Republic of China （eight）＂ added the crime of drink driving to restrain the action of dangerous driving. Law in our country will have the legislation interpretation and judicial interpretation for dangerous driving because of people＇s divergence of its constitutive requirements, which can help to govern drug driving and ＂three exceeds＂ （excessive speed, excess freight and excess seating capacity） and to sustain the public transportation safety. |
