试论中国人法观念的文化继承

辛亥革命虽然结束了帝制时代,但传统法文化并没有消失,旧时代的法观念依然深深埋藏在中国人的内心深处。当代中国社会延续了人治时代对实质正义的追求,也继承了传统的人情、关系及恕道文化,导致对违法的宽容或认同,进而影响法治的进程。

On the Cultural Inheritance of Chinese Law Idea

although the Xinhai revolution ended the monarchy era,the traditional legal culture doesn’t disappear,and the old law idea is still deeply buried in the heart of the Chinese people.The contemporary Chinese society continues the pursuing of substantial justice and also inherits the human feelings,human relationship and forgiveness culture,which leads to illegal tolerance or identity,and influences the process of rule by law.
