| 摘 要： | 法的效率价值反映了制度建构的效率维度，同时，也是制度运行经济合理性的体现。基于知识产权制度区别于其他部门法的特殊性，其效率价值的经济学内涵更多源于对知识产权客体价值属性的认识，即“知识价值论”。近现代的思想家们对于知识财产的不同价值观赋予了知识产权制度效率价值特殊的内涵。在此基础上，以现代制度经济学和法经济学分析框架为基础，以促进和实现效率最大化为目的，构建了现代知识产权制度的效率价值理论。并运用这一基本理论，以帕累托效率为标准对现行知识产权制度中的效率价值进行验证。
