聚讼与规范：经济犯罪概念的认定与特征的“限制”性释义

经济犯罪的概念虽被提出和使用很久,但至今仍未统一定论。我国的刑事政策决定了经济犯罪的客体,经济犯罪主要侵犯的客体是国家整体经济的秩序。本文在对域内外经济犯罪概念进行的聚讼与争鸣分析后,认为经济犯罪是指从事经济活动的自然人和法人在经济运行过程中,实施违反经济法规,侵害经济管理秩序和经济协调关系,情节严重,依法应当承担刑事责任的行为。经济犯罪概念的认定与特征的＂限制＂性释义取得规范,不仅易于了解经济犯罪的特殊性,也可使刑法的效能得到最大发挥。

Divergence and Specification: the Limitation Interpretation of the Affirmation and Characteristics of Economic Crime Concept

the concept of economic crime has been proposed and used for a long time, but it has not been unified. The criminal policy of our country determines the object of economic crimes, and the the main object of the economic crimes infringement is the order of national economy. Based on its analysis, the paper holds that the economic crime refers to the natural person and legal person engaged in economic activity in the process of economic operation who violates economic laws and regulations and encroaches on the order of economic management and economic coordination. To standardize the limitation interpretation of the affirmation and characteristics of economic crime concept is easy not only for us to understand the particularity of economic crimes, but also to make the most efficiency of the criminal law.
