现代中国法学成长的基本逻辑

现代中国法学是现代中国学术体系之型构的一部分,在根本上它是对中国人之现代生活秩序的探讨与表达,因此探讨现代中国法学的逻辑发展必须从现代中国学术体系之生成的背景中去探讨。从知识谱系角度来讲,现代中国学术体系是从四部之学向分科之学转型的一个结果,它是在西方分科学术体系的强大影响之下逐步形成的,因此包括现代中国法学在内的现代中国学术必然会深深地打上西方学术的烙印。但这并不意味着现代中国学术体系走不出西方学术的背影,恰恰相反,现代中国学术之所以为现代的中国的学术,它必须走出西方,回归自己,因为只有回归自我,现代中国学术体系才可以说真正建构起来。现代中国法学正是在极其艰难的知识压力下,不断通过自主性之吁求,在探讨中国人之现代生活的过程之中而逐步成长的。现代中国法学可以看成是现代中国学术体系之型构的一个标本。
