| 摘 要： | 大陆法系对属于违法性阻却事由的错误的假想防卫及其过当存在着极为复杂的理论和激烈的争论,属于事实错误的假想防卫只可能是疏忽大意的过失犯罪或者意外事件,而行为人对其过当部分也正如对防卫过当一样不可能存在故意。

| Abstract: | In continental law system,there are complex theories and in tensive ar -guments about imaginative defence and its excesses which is a kind of the error in ground for elimination of illegality.Imaginative defence is a kind of error of fact which belongs to either crime of careless negligence or fortuitous event and the subjective respect of actor about the excesses of imaginative defence can not have deliberate intent as about the excessive defence. |
