| 摘 要： | 联合国设立的前南国际法庭与卢旺达国际法庭,是国际刑事法院管辖权的早期实践,《国际刑事法院罗马规约》则是解决国际刑事法院管辖权如何与国内法院管辖权相协调的又一次尝试。从对前南和卢旺达两个法庭与国际刑事法院的管辖权的比较,分析国际性法院如何与国内法院的管辖权进行协调,以及何者更为优先的问题。

| Abstract: | The establishment of international criminal jurisdiction appearing in both the International Tribunal in the former Yugoslavia and the one in Rwandawa is an early practice,while Roman stipulation of an agreemeut of international criminal tribunal is another experiment to harmonize international criminal jurisdiction with national one.This essay plans to compare International Criminal Tribunal in the former Yugoslavia(ICTY) and International War Crimes Tribunal in Rwanda(ICTR) with International Criminal Court(ICC),and then discusses how to coordinate international and national jurisdictions. |
