On the phase space approach to complexity

We elaborate in some detail on a new phase space approach to complexity, due to Y.-C. Zhang. We show in particular that the connection between maximal complexity and power law noise or correlations can be derived from a simple variational principle. For a 1D signal we find 1/f noise, in accordance with Zhang.

Banach空间值鞅不等式与弱大数定律

本文证明了Ｂａｎａｃｈ空间值鞅的一些不等式，讨论了Ｂａｎａｃｈ空间的凸性及光滑性与某些鞅不等的式的联系，给出了Ｈｉｌｂｅｒｔ空间的一个鞅不等式刻划，同时还讨论了一致Ｐ光滑空间中鞅的弱大数定律，本文的结论推广与改进了很多熟知的定理。     

论刑事附带民事赔偿的实现

刑事犯罪引起的附带民事赔偿就其性质而言，与一般的民事侵权导致的民事赔偿之间并没有本质的区别。但因前者是附带于刑事案件而启动的一种民事诉讼，导致其与一般的民事诉讼在起诉、受理、审判、执行等 多方面存在很大的区别，而且这种区别在很大程度上阻碍了刑事附带民事赔偿的最终实现，侵害了刑事案件被害人（包括国家）的合法权益，损害了刑事司法的公正性和严肃性。又因目前我国法律法规对刑事附带民事赔偿问题的规定尚存在许多不完善之处，司法实践中对此类问题的处理缺乏统一的标准，致使赔偿的实现进程步骤维艰，故对附带民事赔偿问题的深入研究具有重要的理论价值和巨大的实践意义。文章仅就赔偿的性质、范围、程序以及司法实践中存在的误区及解决方法作初步探讨。     

从东西方文化看以德治国和依法治国

关于法治和德治的争论在东方和西方产生了相似的激烈争论。这种争论已经持续了约 30 0 0年并将继续。法律是最低的道德 ,道德是法治的环境。对于当代中国来说 ,法治和德治都不可或缺 ,不可丢弃。要建设一个文明、民主和强大的中国 ,依法治国具有特别的意义。     

Estimates from Below for the Spectral Function and for the Remainder in Local Weyl’s Law

We obtain asymptotic lower bounds for the spectral function of the Laplacian and for the remainder in local Weyl’s law on manifolds. In the negatively curved case, thermodynamic formalism is applied to improve the estimates. Key ingredients of the proof include the wave equation parametrix, a pretrace formula and the Dirichlet box principle. Our results develop and extend the unpublished thesis of A. Karnaukh [Ka]. 法律传统与法制现代化

法律传统并非只是反映过去的法律文化精神,其中蕴含着许多可被现代法制吸收和借鉴的合理成分。法制现代化所面临的一个重要课题便是如何对待法律传统,如何协调好法制转型中的传统因素与现代因素,进而实现传统法律文化的创造性变革。本文试从法律传统的概念入手,对法制现代化承继法律传统的依据及承继进程中进行选择的必要性作了简要分析。     

Asymptotics in the Baum—Katz formula for random fields

In 1996, D. Deng established an analog of the Baum—Katz theorem on the convergence rate in the law of large numbers for multi-indexed random variables. The series describing the convergence rate depends, in a natural way, on the parameter characterizing the excess of the normalized sums over some level. In this paper, we find the precise asymptotics of the sum of this series with respect to the above-mentioned parameter. Thus, a generalization of a recent result due to A. Gut and A. Spataru is obtained.
