Nanotechnology, as with many technologies before it, places a strain on existing legislation and poses a challenge to all administrative agencies tasked with regulating technology-based products. It is easy to see how statutory schemes become outdated, as our ability to understand and affect the world progresses. In this article, we address the regulatory problems that nanotechnology posses for the Food and Drug Administration’s (FDA) classification structure for “drugs” and “devices.” The last major modification to these terms was in 1976, with the enactment of the Medical Device Amendments. There are serious practical differences for a classification as a drug or device in terms of time to market and research. Drugs are classified, primarily, as acting by “chemical action.” We lay out some legal, philosophic, and scientific tools that serve to provide a useful, as well as legally and scientifically faithful, distinction between drugs and devices for the purpose of regulatory classification. These issues we raise are worth the consideration of anyone who is interested in the regulation of nano-products or other novel technologies.  相似文献

The debate on nonclassical ions centered almost exclusively on the behavior of 2‐norbornyl esters. The hallmark of a nonclassical charge distribution in solvolysis reactions was always seen in the seemingly exceptional fast reaction of the 2‐exo‐derivatives, with slow rates of the endo‐esters. While the nonclassical bridged structure of the free norbornyl ion has been unequivocally established, possible steric contributions to the rate differences in solution remained a matter of debate. Many formerly used solvents were less suited to exhibit uniform reaction mechanisms; the most appropriate solvent hexafluorisopropanol was introduced rather late. Solvolysis rates of many cyclic esters including medium rings can be predicted by force field calculated strain energy differences ΔSIsp3/sp2 between sp3 and sp2 states. Large deviations from the correlation are observed for 2‐tosyloxy norbornane‐ and for 17‐tosyloxy steroids; they indicate that both nonclassical charge delocalization and steric hindrance play a major role for the reactivity differences. These reach an unprecedented rate constant ratio of >30.000 between, eg, the 17‐steroid epimers, much larger than the ratio of 1.550 in 2‐norbornyl reactions. The presence of alkyl groups or hydrogen antiperiplanar to the leaving group can lead to extreme reactivities by 1,2‐shifts or Wagner‐Meerwein rearrangement if asymmetric bridged transition states can occur which approach the stability of tertiary cations. The long controversy about nonclassical ions illustrates how progress in science can deviate significantly from the ideal pathways lined out by Karl Popper.  相似文献

ABSTRACT

Simulated external electric fields are applied to polarisable species containing either a monodisperse of bidisperse distribution of polarisabilities. The magnitude of the external field and the polarisabilities are systematically varied. The application of an external field (of sufficient magnitude) is found to induce chain formation (as expected). The monodisperse systems are found to ‘self-assemble’ with larger induced dipole moments effectively clustering in chains as a result of significant dipole-induced dipole effects. The distribution of the chain lengths is characterised as a function of the applied field and the atom polarisability. For the bidisperse systems, the external field induces chain formation and a partial segregation, in which the more polarisable species preferentially form chains. The chain lengths are again determined as a function of field strength and the atom polarisabilities. Scaling behaviour is analysed.  相似文献

The destruction and transfer of polarization of the rotational angular momentum of small molecules in an isotropic collisional environment is reviewed. Several recent independent treatments are drawn together, including unpublished details from the authors' own work, of the formal kinetics in terms of moments of the density matrix. The final results are shown to be equivalent and directly amenable to comparison with results of exact quantum scattering calculations. In passing, some differences in nomenclature are noted and a self-consistent version is presented that might usefully be adopted. The existing experimental approaches are surveyed, within the common theme of laser-based creation of the initial rotational anisotropy of relatively low rank, K, combined with a spectroscopic probe, also sensitive to restricted K. Those formally defined quantities that may be measured are identified, either individually or in some combination, with each method. In particular, an attempt is made to distinguish between measurements of individual tensor moments of the density matrix, or ‘bulk polarizations’, and alignment moments, which are normalized to the population. Some cases are noted where experimental procedures have compromised the results, or where the analysis has been similarly approximate or carried out on a less rigorous empirical basis.  相似文献

It is unavoidable to deal with the quark and gluon momentum and angular momentum contributions to the nucleon momentum and spin in the study of nucleon internal structure. However we never have the quark and gluon momentum, orbital angular momentum and gluon spin operators which satisfy both the gauge invariance and the canonical momentum and angular momentum commutation relation. The conflicts between the gauge invariance and canonical quantization requirement of these operators are discussed. A new set of quark and gluon momentum, orbital angular momentum and spin operators, which satisfy both the gauge invariance and canonical momentum and angular momentum commutation relation, are proposed. The key point to achieve such a proper decomposition is to separate the gauge field into the pure gauge and the gauge covariant parts. The same conflicts also exist in QED and quantum mechanics and have been solved in the same manner. The impacts of this new decomposition to the nucleon internal structure are discussed.  相似文献

We discuss the possibility that the recent detection of 511 keV gamma rays from the galactic bulge, as observed by INTEGRAL, is a consequence of low mass (1-100 MeV) particle dark matter annihilations. We discuss the type of halo profile favored by the observations as well as the size of the annihilation cross section needed to account for the signal. We find that such a scenario is consistent with the observed dark matter relic density and other constraints from astrophysics and particle physics.  相似文献

The divergence of signals along ecological gradients may lead to speciation. The current research tests the hypothesis that variation in sound absorption selects for divergence in acoustic signals along climatic gradients, which has implications for understanding not only diversification, but also how organisms may respond to climate change. Because sound absorption varies with temperature, humidity, and the frequency of sound, individuals or species may vary signal structure with changes in climate over space or time. In particular, signals of lower frequency, narrower bandwidth, and longer duration should be more detectable in environments with high sound absorption. Using both North American wood warblers (Parulidae) and bats of the American Southwest, this work found evidence of associations between signal structure and sound absorption. Warbler species with higher mean absorption across their range were more likely to have narrow bandwidth songs. Bat species found in higher absorption habitats were more likely to have lower frequency echolocation calls. In addition, bat species changed echolocation call structure across seasons, using longer duration, lower frequency calls in the higher absorption rainy season. These results suggest that signals may diverge along climatic gradients due to variation in sound absorption, although the effects of absorption are modest.  相似文献

In this article, we examine voluntary oversight programs for nanotechnology in the context of corporate social performance (CSP) in order to better understand the drivers, barriers, and forms of company participation in such programs. At the theoretical level, we use the management framework of CSP to understand the voluntary behavior of companies. At the empirical level, we investigate nanotech industry participation in the Environmental Protection Agency’s Nanoscale Materials Stewardship Program (NMSP) as an example of CSP, in order to examine the effects of company characteristics on CSP outcomes. The analysis demonstrates that, on the average, older and larger companies for which nanotech is one of the many business activities demonstrate greater CSP as judged by company actions, declarations, and self-evaluations. Such companies tended to submit more of the requested information to the NMSP, including specific information about health and safety, and to claim fewer of the submitted items as confidential business information. They were also more likely to have on-line statements of generic and nano-specific corporate social responsibility principles, policies, and achievements. The article suggests a need to encourage smaller and younger companies to participate in voluntary oversight programs for nanotechnology and presents options for better design of these programs.  相似文献

Extensive spectroscopic investigations of the emission from a CF4/8% O2 RF discharge in the presence of a silicon substrate strongly suggest that there is a propensity for electron spin angular momentum to be conserved in gas-surface interactions. The examples chosen are of doublet and quartet F atoms and singlet, triplet and quintet F+ ions interacting with the surface of a Si(100) wafer. Experiments were carried out in a parallel plate plasma etcher and the results are of relevance to an understanding of basic mechanisms in plasma etching in VLSI fabrication and of discharge-surface interactions in general.  相似文献

This Letter introduces the concept of generalized bi-Schrödinger maps from a Riemannian manifold into a symplectic manifold. The Fukumoto-Moffatt?s model in the vortex filament is shown to be exactly the generalized bi-Schrödinger maps from R1 into S2?R3. An obvious criterion to classify theories of modified gravity is to identify their gravitational degrees of freedom and their coupling to the metric and the matter sector. Using this simple idea, we show that any theory which depends on the curvature invariants is equivalent to general relativity in the presence of new fields that are gravitationally coupled to the energy-momentum tensor. We show that they can be shifted into a new energy-momentum tensor. There is no a priori reason to identify these new fields as gravitational degrees of freedom or matter fields. This leads to an equivalence between dark matter particles gravitationally coupled to the standard model fields and modified gravity theories designed to account for the dark matter phenomenon. Due to this ambiguity, it is impossible to differentiate experimentally between these theories and any attempt of doing so should be classified as a mere interpretation of the same phenomenon.  相似文献

In this paper we put forward a running coupling scenario for describing the interaction between dark energy and dark matter. The dark sector interaction in our scenario is free of the assumption that the interaction term Q is proportional to the Hubble expansion rate and the energy densities of dark sectors. We only use a time-variable coupling b(a) (with a the scale factor of the universe) to characterize the interaction Q. We propose a parametrization form for the running coupling b(a)=b 0 a+b e (1−a) in which the early-time coupling is given by a constant b e , while today the coupling is given by another constant, b 0. For investigating the feature of the running coupling, we employ three dark energy models, namely, the cosmological constant model (w=−1), the constant w model (w=w 0), and the time-dependent w model (w(a)=w 0+w 1(1−a)). We constrain the models with the current observational data, including the type Ia supernova, the baryon acoustic oscillation, the cosmic microwave background, the Hubble expansion rate, and the X-ray gas mass fraction data. The fitting results indicate that a time-varying vacuum scenario is favored, in which the coupling b(z) crosses the noninteracting line (b=0) during the cosmological evolution and the sign changes from negative to positive. The crossing of the noninteracting line happens at around z=0.2–0.3, and the crossing behavior is favored at about 1σ confidence level. Our work implies that we should pay more attention to the time-varying vacuum model and seriously consider the phenomenological construction of a sign-changeable or oscillatory interaction between dark sectors.  相似文献
